Any time an organization has reasonable threat of litigation, a legal hold likely should be issued. The hold should highlight a variety of details, including but not limited to, types of information to retain, date through which information should be retained, contact information if questions about the hold arise, and more. A triggering event can happen at any time, so it’s best for organizations to be prepared and have a process in place to manage holds if they become necessary.
